These terms explain what hosts, guests, and account owners can expect when creating pages, sharing content, making purchases, and using Moments.

Hosts control the event experience, guests control what they submit, and Dayzy provides the platform that helps bring those pieces together.

Use Moments responsibly

Hosts and guests are responsible for the event details, photos, messages, files, RSVP data, and other content they add.

You keep your content

You keep ownership of what you upload, while giving Dayzy the permission needed to operate and display it through Moments.

Plans, donations, and payouts have rules

Personal trials, paid plans, Founder Lifetime access, event donations, service fees, security holds, payout eligibility, disputes, and taxes are governed by these Terms and provider rules.

Community rules still apply

The Community Guidelines are part of keeping event pages safe, respectful, and useful for hosts and guests.

Terms of Service

1. Agreement to These Terms

These Terms of Service explain the rules for using Moments by Dayzy, including our websites, event pages, dashboards, forms, templates, communications, and related services.

By creating an account, publishing an event page, submitting content, making a purchase, starting a trial, sending or receiving a donation, requesting a payout, connecting a payout account, or otherwise using Moments, you agree to these Terms. If you use Moments on behalf of a school, business, nonprofit, family, client, beneficiary, event host, or other organization, you confirm that you are allowed to accept these Terms for that organization.

If you do not agree to these Terms, do not use Moments.

2. Who We Are

Moments by Dayzy is owned and operated by Dayzy. Moments helps hosts create event pages, share important details, collect RSVPs, receive guest submissions, display photos or messages, and manage event-related experiences.

In these Terms, Dayzy, Moments, we, us, and our refer to Dayzy and the Moments by Dayzy product. Hosts are people or organizations who create or manage event pages. Guests are people who visit, RSVP, upload, submit, or interact with an event page.

3. Accounts and Eligibility

You are responsible for providing accurate account information and keeping it current. You are also responsible for safeguarding your login credentials and for activity that happens through your account.

If you use paid plans, donation features, payout features, or connected account features, you must provide accurate billing, tax, identity, banking, contact, and compliance information when requested by Dayzy, Stripe, banks, card networks, or other providers.

Moments is intended to be used by adults or by users with appropriate involvement from a parent, guardian, school, organization, or responsible adult. If an event involves children or minors, the host is responsible for using appropriate care before publishing names, photos, school details, locations, or other personal information.

You may not access another person's account, event page, guest list, dashboard, upload area, or private link without permission.

4. Hosts and Event Pages

Hosts are responsible for the event pages they create, including event details, names, dates, times, locations, schedules, images, guest lists, RSVP fields, upload settings, visibility settings, links, and any other content added to the page.

Hosts must have the rights, permissions, and authority needed to publish event content and collect information from guests. This includes permission to use photos, names, logos, school or organization references, private addresses, and guest information when applicable.

Hosts should keep event details accurate and updated. Dayzy is not responsible for incorrect event information, venue changes, scheduling issues, invitation mistakes, or decisions made by hosts or guests based on event page content.

5. Guests and Event Contributions

Guests may be able to RSVP, submit messages, upload photos, sign guestbooks, answer questions, provide contact information, or otherwise contribute to an event page depending on the host settings.

Guest submissions may be visible to the host, event administrators, other guests, or public visitors depending on the event settings and feature being used. Do not submit content or personal information unless you are comfortable sharing it in that event context.

Guests are responsible for the content they submit and should not upload anything they do not own or have permission to share.

6. User Content and Permission to Operate Moments

You keep ownership of the content you submit to Moments, including event text, photos, messages, guestbook entries, files, and other materials you provide.

To operate Moments, you give Dayzy a non-exclusive, worldwide, royalty-free permission to host, store, copy, process, display, transmit, resize, format, and otherwise use your content as needed to provide, protect, maintain, and improve the service.

You confirm that you have the rights needed to submit the content and grant this permission. You also understand that deleting content from active pages may not remove it from backups, logs, emails, cached copies, or records we are allowed or required to keep.

7. Acceptable Use

You may not use Moments for illegal activity, harassment, threats, hateful conduct, abuse, impersonation, scams, spam, malware, phishing, deceptive pages, unauthorized promotions, privacy violations, or content that exploits or harms another person.

You may not use Moments for fraudulent payments, self-dealing donations, deceptive fundraising, money laundering, sanctions violations, unauthorized raffles, illegal lotteries, regulated financial activity, false emergency claims, false charitable claims, or any payment, donation, or payout activity that violates law or provider rules.

You may not try to interfere with the service, bypass security controls, scrape data, reverse engineer protected parts of the platform, overload systems, misuse invite links, or access data you are not allowed to access.

Our Community Guidelines provide more detail about behavior and content standards for event pages and guest interactions.

8. Purchases, Subscriptions, Trials, Founder Lifetime, and Cancellation

Some Moments features, templates, storage, event packages, subscriptions, add-ons, or services may require payment. The plan, checkout page, invoice, order form, or separate written agreement controls the specific price, billing period, renewal terms, included features, and cancellation terms for that purchase.

New accounts may be placed automatically into a Personal trial without payment required. The Personal trial is not a free plan, free lifetime account, or promise of permanent access. Unless Dayzy states otherwise in writing, you must add a valid payment method before the trial ends to keep the account active. Dayzy may send trial reminders, limit features, pause access, or deactivate the account if payment is not added before the trial ends.

Personal and Professional subscriptions may renew automatically through Stripe or another payment processor. If a plan renews automatically, you authorize recurring charges until the plan is canceled. You are responsible for reviewing renewal details before purchase, keeping payment information current, and canceling before the renewal date if you do not want the plan to continue.

Plan changes may take effect immediately, at the next billing period, or according to the payment processor rules shown at checkout or in the billing portal. Proration, credits, taxes, discounts, failed payments, grace periods, renewal dates, and payment collection may be handled by Stripe or another processor.

Unless a checkout page, written agreement signed by Dayzy, or applicable law says otherwise, fees are not refundable once paid. Failed payments, chargebacks, payment disputes, suspected fraud, abuse, excessive support burden, prohibited activity, or account misuse may result in limited access, paused service, cancellation, termination, or account review.

The Moments - Founder Lifetime license is a limited promotional membership. "Lifetime" means access for the life of the Moments service as operated by Dayzy, not for the lifetime of any individual user, account owner, organization, device, event, or customer. The Founder Lifetime license does not guarantee that Moments, any specific feature, template, integration, storage amount, support level, third-party service, or pricing for separate add-ons will remain available permanently or unchanged.

Founder Lifetime licenses are limited to the first 50 qualifying accounts unless Dayzy changes that limit in writing. They are personal to the purchasing account, non-transferable unless Dayzy approves otherwise in writing, and may be suspended or terminated for breach of these Terms, illegal activity, fraud, account sharing outside permitted use, abuse, security risk, chargebacks, payment disputes, or other conduct that threatens Dayzy, Moments, users, guests, vendors, or the service.

If Dayzy discontinues, materially replaces, sells, merges, rebrands, winds down, or is unable to continue operating Moments, Founder Lifetime access may end with the service. No refund, credit, cash value, substitute product, or ongoing access is owed for a Founder Lifetime license except where required by applicable law or expressly stated in a separate written agreement signed by Dayzy.

9. Event Donations, Service Fees, Payouts, Refunds, and Disputes

Moments may allow guests to send voluntary event donations or guest support payments through secure checkout. Donations are processed by Stripe or another payment provider and may include a Moments service fee, payment processing fees, payout fees, taxes, or other amounts shown at checkout or in the dashboard.

Unless Dayzy expressly states otherwise in writing, Dayzy is not a charity, nonprofit, professional fundraiser, escrow agent, bank, money transmitter, fiduciary, financial advisor, tax advisor, or guarantor of any host, event, donor, donation purpose, beneficiary, or payout. Event donations are not tax-deductible charitable contributions through Dayzy unless the receiving host is legally eligible and provides its own legally sufficient receipt or documentation.

Hosts are solely responsible for how donations are requested, described, used, reported, taxed, acknowledged, refunded, or fulfilled. Hosts must not make false, misleading, unlawful, deceptive, or unsupported claims about donation purpose, nonprofit status, tax deductibility, beneficiary identity, medical need, emergency need, memorial fund use, prize eligibility, matching funds, or any other donation-related representation.

Donors are responsible for reviewing the event page, donation amount, service fee, total checkout amount, recipient context, and any host-provided statements before paying. Dayzy does not guarantee that a host will use funds in any particular way, that an event will occur, that a beneficiary will receive funds, or that a donation will be refundable.

Donation records may be held for security review before payout eligibility. Dayzy may impose minimum and maximum donation amounts, event-level limits, rate limits, waiting periods, payout minimums, payout fees, identity verification requirements, refund or dispute holds, fraud review, manual review, or other risk controls. Dayzy may block, delay, reverse, offset, withhold, or decline donations or payouts when required by law, payment processor rules, card network rules, suspected fraud, chargebacks, disputes, sanctions, compliance review, prohibited activity, technical error, or risk to Dayzy, Stripe, hosts, donors, guests, or the service.

Hosts must complete Stripe Connect or other required payout onboarding before receiving payouts. Stripe or another provider may require identity, tax, banking, address, phone, date of birth, business, or compliance information and may approve, reject, delay, restrict, disable, or close payout access under its own rules. Dayzy does not control provider verification decisions, bank timing, card network rules, payout timing, reserves, or account restrictions.

Refunds, chargebacks, disputes, reversals, failed payments, suspected fraudulent payments, and payment processor fees may reduce, delay, or eliminate donation balances or payouts. If funds have already been paid out and a refund, dispute, reversal, fee, tax, or processor obligation later arises, the host remains responsible for the affected amount and authorizes Dayzy to offset future payouts, request repayment, suspend donation features, or take other lawful recovery steps.

10. Templates, Software, and Dayzy Materials

Dayzy owns or licenses the Moments platform, templates, layouts, designs, code, workflows, copy, graphics, branding, and other materials we provide, excluding user content submitted by hosts or guests.

We give you a limited permission to use Moments and its included materials for your own event pages through the service. You may not copy, resell, redistribute, sublicense, or use the platform materials to create a competing product without written permission from Dayzy.

11. Privacy

Our Privacy Policy explains how Dayzy collects, uses, shares, and protects information for Moments. By using Moments, you acknowledge that information will be handled as described in the Privacy Policy.

Hosts are responsible for giving guests appropriate context about what information is being collected for an event, how that event information will be used, and whether guest submissions, donation notes, donor names, RSVP details, photos, or messages may be visible to others.

Payment processors, payout providers, banks, card networks, and connected account providers may collect and process information under their own terms and privacy policies.

12. Third-Party Services

Moments may use or link to third-party services such as payment processors, hosting providers, email tools, analytics tools, maps, registries, social platforms, embedded media, or vendor websites.

Third-party services are controlled by their own terms and privacy practices. Dayzy is not responsible for third-party websites, services, errors, outages, fees, policies, or content.

Stripe Checkout, Stripe Billing, Stripe Connect, Stripe-hosted onboarding, Stripe billing portals, WooCommerce checkout, card networks, banks, fraud-prevention vendors, fulfillment partners, maps, email delivery, messaging, analytics, fonts, media, and embedded tools may require users to accept additional provider terms. Provider requirements may affect subscriptions, donations, payouts, refunds, disputes, taxes, identity verification, account access, and available payment methods.

Access to third-party services, integrations, payment processing, payout processing, fulfillment partners, maps, email delivery, messaging, analytics, fonts, media, or embedded tools may change or stop if those providers change their services, terms, pricing, availability, risk rules, compliance requirements, or technical requirements.

13. Copyright and Intellectual Property Concerns

If you believe content on Moments infringes your copyright, trademark, privacy, publicity, or other rights, email maven@mydayzy.com with enough detail for us to review the issue, including the event link, the content at issue, your contact information, and a clear explanation of your concern.

We may remove or disable access to content, contact the host, request more information, or take other action we believe is appropriate. Repeated or serious violations may lead to account suspension or termination.

14. Moderation, Suspension, and Termination

We may review, remove, restrict, suspend, disable, refuse, reverse, or terminate content, event pages, accounts, subscriptions, donations, payout access, guest submissions, or features if we believe there is a violation of these Terms, the Community Guidelines, applicable law, platform security, payment obligations, provider requirements, or the rights or safety of others.

We may take action without prior notice when needed to protect Dayzy, Moments, hosts, guests, donors, vendors, payment processors, payout providers, card networks, banks, or the public from suspected fraud, abuse, security risk, illegal activity, payment risk, chargebacks, disputes, sanctions risk, deceptive fundraising, or other harm.

You may stop using Moments at any time. Some obligations in these Terms continue after account closure or service termination, including payment obligations, repayment obligations, donation and payout obligations, content permissions needed for prior service operation, ownership terms, disclaimers, limits of liability, indemnity, and dispute provisions.

15. Changes, Availability, and In-Progress Features

Moments is a growing product, and features may be added, changed, paused, removed, renamed, limited, or updated over time. We do not guarantee that every feature, template, integration, storage option, or workflow will always remain available.

We work to keep Moments reliable, but online services can experience maintenance, outages, data delays, third-party failures, bugs, or security events. Hosts should keep their own copies of important event details, files, and guest communications when needed.

Lifetime, Founder Lifetime, permanent, unlimited, future updates, or similar wording does not limit Dayzy's right to modify, limit, suspend, discontinue, replace, sell, merge, rebrand, or wind down any part of Moments, including paid features, templates, integrations, or account benefits.

16. Disclaimers

Moments is provided on an as-is and as-available basis to the fullest extent permitted by law. Dayzy does not promise that the service will be uninterrupted, error-free, secure, compatible with every device, or suitable for every event, business, legal, tax, financial, school, venue, fundraising, donation, or personal need.

Dayzy does not control or guarantee host-created event content, guest submissions, venue information, RSVP accuracy, attendance, donation purpose, donor intent, host use of funds, payout timing, third-party services, payment method availability, provider decisions, or decisions made by hosts, guests, donors, banks, processors, card networks, or other third parties.

Nothing in Moments is legal, tax, financial, fundraising, accounting, medical, safety, event planning, or professional advice. Hosts, donors, and account owners should consult qualified advisors where appropriate.

17. Limitation of Liability

To the fullest extent permitted by law, Dayzy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, event disruption, reputational harm, donation loss, payout delay, chargeback, dispute, tax consequence, account restriction, third-party provider action, or the cost of substitute services.

To the fullest extent permitted by law, Dayzy's total liability for any claim related to Moments will be limited to the amount you paid directly to Dayzy for Moments during the 12 months before the claim, excluding pass-through amounts, donations, donor-paid service fees, taxes, payment processor fees, payout amounts, refunds, chargebacks, and third-party charges, or 100 dollars if you did not pay Dayzy directly for Moments during that period.

18. Indemnity

You agree to defend, indemnify, and hold Dayzy harmless from claims, losses, damages, liabilities, costs, fees, chargebacks, refunds, reversals, penalties, taxes, investigations, and expenses, including reasonable attorneys' fees, arising from your use of Moments, your content, your event page, your guest interactions, your purchases, your donation requests, your donor communications, your use or receipt of payouts, your tax or reporting obligations, your violation of these Terms, your violation of payment processor rules, or your violation of someone else's rights.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules, unless applicable consumer protection law requires otherwise.

Before filing a claim, you agree to contact Dayzy at maven@mydayzy.com so we can try to resolve the issue informally. If a dispute cannot be resolved informally, it will be handled in the state or federal courts located in Texas unless applicable law requires a different forum.

Payment processor disputes, chargebacks, connected account restrictions, payout holds, refunds, card network disputes, bank returns, and provider account reviews may also be governed by the rules and dispute processes of Stripe, banks, card networks, or other payment providers.

20. Updates to These Terms

We may update these Terms as Moments changes, legal requirements evolve, or business practices are refined. The updated Terms will be posted on this page with a new effective date.

Your continued use of Moments after updated Terms are posted means you accept the updated Terms.
